FDA issues proposed rules requiring calorie content on menus

The US Food and Drug Administration (FDA) has issued proposed calorie labeling rules requiring most retail food vendors to display the calorie counts in items on their menus and menu boards. The proposed rules, issued Friday and expected to be finalized in 2012, would apply to most restaurants, snack bars, vending machines, coffee shops, drive-through restaurants, and convenience and grocery stores.

The US Congress required the rules in the health-care reform law passed in 2010. The rules proposed by the FDA must undergo a public comment period before they are finalized and take effect, said Michael R. Taylor, Deputy Director for Foods at the FDA.

The proposed regulations pertain to businesses devoting more than 50 percent of their floor space to the sale of food or that consider themselves restaurants, specifically food-selling chains with at least 20 stores nationally. Included are candy stores, bakeries, and ice-cream parlors.

The FDA’s proposed guidelines specify that chains post the calorie counts of foods and drinks on menus and menu boards or next to the food item, such as at a salad bar. The menu is to prominently exhibit the calorie content of each item in a way customers can see easily, giving them the same information packaged foods prepared at home currently provide. The information must be displayed in “clear and conspicuous” print and colors.

Giving consumers clear nutritional information makes it easier for them to choose healthier options that can help fight obesity and make us all healthier.

Many cities and states have passed laws requiring calorie labeling on menus, beginning with New York City in 2008. California implemented a similar law in January, although many counties are waiting for the release of the federal guidelines before they begin enforcement. Some fast-food chains there, such as McDonald’s and Starbucks, are displaying calorie counts on menus in some of their stores.

The rules are intended to curb the national obesity epidemic since, according to FDA estimates, one third of the calories people consume yearly come from food eaten out. In a statement issued yesterday, Kathleen Sebelius, Secretary of Health and Human Services said, “Giving consumers clear nutritional information makes it easier for them to choose healthier options that can help fight obesity and make us all healthier.”

Excluded from the rules are businesses whose primary product is not food sales but that sell it, such as bowling alleys, airports and airplanes, amusement parks, hotels and movie theaters. Alcohol is also excluded.

Tuesday, March 29, 2005A team of Australian surgeons yesterday reattached both hands and one foot to 10-year-old Perth boy, Terry Vo, after a brick wall which collapsed during a game of basketball fell on him, severing the limbs. The wall gave way while Terry performed a slam-dunk, during a game at a friend’s birthday party.

The boy was today awake and smiling, still in some pain but in good spirits and expected to make a full recovery, according to plastic surgeon, Mr Robert Love.

“What we have is parts that are very much alive so the reattached limbs are certainly pink, well perfused and are indeed moving,” Mr Love told reporters today.

“The fact that he is moving his fingers, and of course when he wakes up he will move both fingers and toes, is not a surprise,” Mr Love had said yesterday.

“The question is more the sensory return that he will get in the hand itself and the fine movements he will have in the fingers and the toes, and that will come with time, hopefully. We will assess that over the next 18 months to two years.

“I’m sure that he’ll enjoy a game of basketball in the future.”

The weight and force of the collapse, and the sharp brick edges, resulted in the three limbs being cut through about 7cm above the wrists and ankle.

Terry’s father Tan said of his only child, the injuries were terrible, “I was scared to look at him, a horrible thing.”

The hands and foot were placed in an ice-filled Esky and rushed to hospital with the boy, where three teams of medical experts were assembled, and he was given a blood transfusion after experiencing massive blood loss. Eight hours of complex micro-surgery on Saturday night were followed by a further two hours of skin grafts yesterday.

“What he will lose because it was such a large zone of traumatised skin and muscle and so on, he will lose some of the skin so he’ll certainly require lots of further surgery regardless of whether the skin survives,” said Mr Love said today.

The boy was kept unconscious under anaesthetic between the two procedures. In an interview yesterday, Mr Love explained why:

“He could have actually been woken up the next day. Because we were intending to take him back to theatre for a second look, to look at the traumatised skin flaps, to close more of his wounds and to do split skin grafting, it was felt the best thing to do would be to keep him stable and to keep him anaesthetised.”

Professor Wayne Morrison, director of the respected Bernard O’Brien Institute of Microsurgery and head of plastic and hand surgery at Melbourne’s St Vincent’s Hospital, said he believed the operation to be a world first.

A new 154-page Government Accountability Office (GAO) report says seven federal departments together spent US$1.6 billion on 343 contracts with public relations firms, advertising agencies, and media organizations, as well as individuals involved in such activities.

Congressional Democrats requested the report after several incidents surfaced in which journalists or commentators were paid to promote the Bush administrations programs, but did not disclose the financing, so called payola. In one case, Armstrong Williams was paid $186,000 for promotions of President Bush’s No Child Left Behind law. The administrations position was that an agencies’ mission includes spreading information about federal programs.

At that time, the GAO had independent objections to the ready-to-air news stories the administration’s provided to TV stations in order to promote it policies. The administration claimed the burden of disclosure falls to the TV stations.

Congress has now inserted a provision into an annual spending bill requiring federal agencies to include “a clear notification” within the text or audio of a prepackaged news story that it was prepared or paid for by the government.

Rep. Henry A. Waxman (D-Calif.) said “Careful oversight of this spending is essential given the track record of the Bush administration, which has used taxpayer dollars to fund covert propaganda within the United States.”

The seven agencies covered by the report are Commerce, Defense, Health and Human Services, Homeland Security, Interior, Treasury, and Veterans Affairs.

Israel’s parliament, the Knesset, voted against a bill calling for a referendum on Prime Minister Ariel Sharon’s controversial plan to withdraw Israeli forces and civilians from the Gaza Strip and some parts of the West Bank. The vote passed 72-39, with three abstentions and six absent. The vote removes the last major hurdle for Mr. Sharon to implement the proposed plan, scheduled to start in July.

Mr. Sharon’s administration has not yet survived the upcoming vote on the 2005 budget, which takes place on Tuesday. But it has secured the support of the secular Shinui party, so a majority looks likely. Shinui had reservations about the amount of money transferred under the budget to projects organised by ultra-Orthodox parties. Under Israeli law, if the budget fails to pass, new elections must be held. Opponents of the disengagement plan intend to use the budget vote to topple Mr. Sharon’s government, and several MK’s attacked Shinui for their decision to support the budget.

Mr. Sharon’s position sparked a rebellion from his own center-right Likud party, with a significant majority of Likud MKs voting in favour of the bill, including several members of his own cabinet. Finance Minister Binyamin Netanyahu, Foreign Minister Silvan Shalom, Justice Minister Tzipi Livni, and Education Minister Limor Livnat all voted in favour of a referendum.

Arthur Oliver Kostendt, a candidate running in the mayoral election of the US city of Cleveland, Ohio set to take place November 2, discussed his campaign and policies with Wikinews this spring.

According to Cleveland Scene, 29-year-old Kostendt is a member of the Cuyahoga County, Ohio Republican Party but has referred to his campaign as “casual”. According to his web site’s personal biography, he was a cadet for the Army Reserve Officers’ Training Corps (ROTC), scout platoon leader for the 2nd Squadron of the 107th Cavalry Regiment of the Ohio Army National Guard and logistics officer for the 1st Battalion of the 145th Armored Regiment. He served in Kuwait, Iraq, the United Arab Emirates and Saudi Arabia and assisted coalition force detachments in Southeast Asia.

Kostendt is a graduate of the University of Notre Dame and summa cum laude graduate of Cleveland State University. He writes he uses an apostrophe to abbreviate his middle name as “Arthur O’Kostendt” instead of the customary period after the O to emphasise his Irish heritage.

A poll published May 5 by Baldwin Wallace University, which does not feature Mr Kostendt, has Dennis Kucinich and Basheer Jones leading in the mayoral race by 17.8 and 13.3 points, respectively, with a margin of error of up to five per cent either way. 48% of those surveyed were undecided. Incumbent mayor Frank G. Jackson, who won the 2017 Cleveland mayoral election with 59% of the vote, is eligible for a fifth term but announced on May 6 he would retire.

Chinese officials have said that their country’s exports surged last December to edge out Germany as the world’s biggest exporter.

The official Xinhua news agency reported today that figures from the General Administration for Customs showed that exports jumped 17.7% in December from a year earlier. Over the whole of 2009 total Chinese exports reached US$1.2 trillion, above Germany’s forecast $1.17 trillion.

Huang Guohua, a statistics official with the customs administration, said the December exports rebound was an important turning point for China’s export sector. He commented that the jump was an indication that exporters have emerged from their downslide.

“We can say that China’s export enterprises have completely emerged from their all-time low in exports,” he said.

However, although China overtook Germany in exports, China’s total foreign trade — both exports and imports — fell 13.9% last year.

200,000 people living around Harare, Zimbabwe have been evicted from their homes, which have been targeted in a demolition programme by the government. Most have been forced to sleep out in the open while rental prices in the city have skyrocketed.

The operations have targeted at least six Harare suburbs: Hatcliff extension, Epworth, Dzivaresekwa, Glenorah, Glenview, Budriro and Mbare.

The official government newspaper, The Herald, says that 22,735 people have been arrested in the drive against “illegal structures, businesses and criminal activities”.

The Zimbabwe Human Rights Association (ZimRights) are pressing for the government for a six month waiting period to give residents time to make new housing arrangements. ZimRights director Munyaradzi Bidi told the IRIN news service: “About 200,000 people have been affected in the demolition drive — and many of them have papers to prove that they were legal occupants with lease agreements”.

In the biggest ever narcotics haul in India’s capital, the New Delhi police have seized over 4,400 kg of Mandrax and Rs. 20 crore from a dealer in the city. The consignment, meant for a customer in the U.S, was seized from a godown in Badarpur, near the Delhi-Haryana border. The alleged trafficker, identified as Vinod Sharma, claimed that the contraband was not his and that he had nothing to do with the matter. Sharma started his career as a scrap-dealer in Delhi, and police suspect that with the help of some contacts he used container depots for drug-trafficking, whilst successfully dodging both the police and the Customs Department.

On Sunday the Delhi Police arrested him at his Kalkaji residence. The Deputy Commissioner of Police for South District, Delhi Police, Anil Shukla said, “Sharma befriended container drivers and once they had driven past customs, he and his men would meet them at a distance and pilfer the containers.”

Yao Jiaxin, a 21-year-old student at the Xi’an Conservatory of Music, was sentenced to death on Friday. Yao, from Xi’an in China’s Shaanxi province, was convicted of homicide after stabbing a cyclist to death.

On the night of October 20, 2010, Yao ran into 26-year-old cyclist and mother of a two-year-old, Zhang Miao, while driving his car. After he saw her writing down his vehicle’s license plate number following the accident, he feared she would report him, and proceeded to murder her by stabbing her six times. Prior to her murder, Zhang had suffered only minor injuries in the accident, according to police.

On October 23, after being accused of murdering her, Yao went to the local police station with his parents and confessed to the crime. He said he killed Zhang because she had seen his license plate number, and he feared that the “peasant woman would be hard to deal with.”

During a three-hour trial on March 23, 2011, Yao’s lawyer pleaded for a lenient sentence, saying it was a “crime of passion.” Yao tearfully described how he had been forced to play the piano, leading him to thoughts of suicide. But prosecutors and judges said Yao did not deserve leniency, as he had not attempted to help the woman after the accident but instead murdered her.

Public passions were raised and some thought Yao would get off through the influence of his family. The case triggered a public debate over the death penalty.

“The motive is extremely despicable … the measures are extremely cruel … and the consequence is extremely serious,” said the court in its judgment.

Blizzard Entertainment has won a federal ruling in the U.S. Court of Appeals against the programmers of bnetd, a software package that emulates Blizzard’s Battle.net service. The court reaffirmed the original judgement, given in October, that the Digital Millennium Copyright Act and click-through EULA’s prohibited the reverse engineering of Blizzard’s software in order to improve their playability. This was the first real test of the DMCA’s applicability.

Bnetd, released under the GNU General Public License, was created to enable users to play multiplayer games, bypassing Blizzard’s freely accessible Battle.net servers, which have sometimes been unreliable or slow for gamers. The software also disabled the CD-Key check which is present in Battle.net to prevent users of pirated copies from being able to connect to Blizzard’s servers. Offers by bnetd developers to incorporate Blizzard’s CD-Check system were declined.

The CD-Check system itself has faced controversy, with some users complaining it borders on breaching privacy in the same way as adware and other malevolent software. This is not confined to Blizzard: controversy occurred when Sony Online Entertainment’s EverQuest had a similar system which was later disabled due to complaints. Other games designed for network play are also known to have similar systems in place, the most prominent perhaps being Valve Software’s Steam system developed for Half-Life 2.

Blizzard has produced many popular titles such as Starcraft, World of Warcraft and the Diablo series.
